Terms of Service

The agreement between you and AccessLumens for use of the Service.

These Terms of Service (“Terms”) govern your access to and use of the AccessLumens website, scanning tools, and reports (the “Service”), operated by [Legal Entity Name] (“AccessLumens,” “we,” “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

AccessLumens provides automated accessibility analysis of websites and generates reports and scores. The Service evaluates only a subset of accessibility criteria and is provided for informational purposes. See our Methodology and Accessibility Disclaimer.

2. Eligibility

You must be at least 16 years old and able to form a binding contract. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

3. Acceptable use

You agree that you will:

  • Only submit URLs for websites that you own or are authorised to test. You are solely responsible for ensuring you have the right to scan a given site and for complying with all applicable laws (including computer-misuse and anti-hacking laws).
  • Not use the Service to scan sites in a manner that is unlawful, abusive, or that overloads or disrupts the target site or our infrastructure.
  • Not attempt to reverse engineer, resell, or circumvent paywalls, rate limits, or access controls of the Service.
  • Not submit URLs containing other people’s personal data or content you are not permitted to process.

4. Reports, payments, and refunds

  • A free scan provides a summary view. Full reports are unlocked by a one-time payment per scan, charged in US dollars via our payment provider and Merchant of Record, Dodo Payments, at the price shown at checkout.
  • Prices and what is included may change over time; the price shown at the time of purchase applies to that purchase.
  • Any applicable taxes are calculated and collected at checkout by our Merchant of Record.
  • Reports are digital goods delivered immediately upon unlock. To the extent permitted by law, payments are non-refundable. If a report failed to generate or you were charged in error, contact support@accesslumens.com and we will make it right.
  • Unlocking a report applies to that specific scan. Re-running a scan creates a new scan, which is priced separately.

5. No warranty; not a certification or legal advice

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AccessLumens does not warrant that results are complete, error-free, or that the Service detects all accessibility issues. A report is not a conformance certification and is not legal advice. It does not guarantee compliance with the ADA, Section 508, the European Accessibility Act, WCAG, or any other law or standard.

6. Limitation of liability

To the maximum extent permitted by law, AccessLumens and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the scan giving rise to the claim or US $50.

7. Indemnification

You agree to indemnify and hold harmless AccessLumens from claims, damages, and expenses arising from your misuse of the Service or your scanning of sites you were not authorised to test.

8. Intellectual property

We own the Service, including its software, scoring models, and design. We grant you a limited, non-exclusive licence to use the Service and the reports you generate for your own internal business purposes. You retain ownership of the content of your own website.

9. Third-party services

The Service relies on third parties (including Dodo Payments for payments and OpenAI for summary generation). Your use of those features may also be subject to those providers’ terms.

10. Suspension and termination

We may suspend or terminate access to the Service at any time for conduct that violates these Terms or that we reasonably believe is harmful to the Service, other users, or third parties.

11. Changes to these Terms

We may update these Terms from time to time. Material changes take effect when we post the updated Terms and revise the “Last updated” date. Continued use of the Service constitutes acceptance.
